President Obama Signs Emergency Declaration for Louisiana

WASHINGTON — The U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) announced that federal emergency aid has been made available to the State of Louisiana to supplement state and local response efforts in the areas affected by flooding during the period of December 28, 2015 to February 1, 2016.

The President’s action authorizes FEMA to coordinate all disaster relief efforts that have the purpose of alleviating the hardship and suffering caused by the emergency on the local population, and to provide appropriate assistance for required emergency measures, authorized under Title V of the Stafford Act, to save lives and to protect property and public health and safety, and to lessen or avert the threat of a catastrophe in the parishes of Concordia, Plaquemines, Pointe Coupee, St. Landry, St. Mary, Terrebonne, and West Feliciana.

Gerard M. Stolar has been named as the Federal Coordinating Officer for federal response operations in the affected area.

President Obama Signs Emergency Declaration for Michigan

WASHINGTON, D.C. — The U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) announced that federal emergency aid has been made available to the State of Michigan to supplement state and local response efforts in the area affected by contaminated water beginning on April 25, 2014, and continuing.

Specifically, FEMA is authorized to identify, mobilize, and provide at its discretion, equipment and resources necessary to alleviate the impacts of the emergency. Emergency protective measures, limited to direct federal assistance, will be provided at 75 percent federal funding. This emergency assistance is to provide water, water filters, water filter cartridges, water test kits, and other necessary related items for a period of no more than 90 days.

Additionally, the President offered assistance in identifying other Federal agency capabilities that could support the recovery effort but do not require an emergency declaration under the Stafford Act.

Summary Paragraph

The Applicant is appealing FEMA’s determination in Project Worksheet (PW) 3094 that bank armoring, sediment reworking, and associated construction mobilization and engineering costs were ineligible for PA funding as emergency protective measures. Heavy rains from Tropical Storm Irene (“Irene”) deposited large quantities of debris and sediment along the Roaring Branch of the Walloomsac River causing flooding, bank erosion, redirected flow, and compromised channel capacity. The Applicant requested about $3.5 million for debris removal, bank armoring, and sediment reworking as emergency protective measures. FEMA determined that sediment reworking and bank armoring were ineligible for funding as emergency protective measures because the work exceeded that which was necessary to lessen or eliminate immediate threats. On first appeal, the Applicant contended that bank armoring and sediment reworking were essential to reduce immediate threats. The FEMA Region I Regional Administrator found that bank armoring and sediment reworking were ineligible for funding both as emergency protective measures and as permanent work. On second appeal, the Applicant maintains that sediment reworking and bank armoring were performed to reduce immediate threats. FEMA subsequently requested that the Applicant provide additional support that the damage was directly caused by the declared disaster, given the occurrence of subsequent Tropical Storm Lee shortly after Irene, the work performed reduced immediate threats, including characterization of the 5-year flood event on Roaring Branch, and predisaster design and maintenance records for the armored banks. The Applicant provided documents stating that (1) the damage was directly related to Irene and distinguished the work from that previously identified in a river corridor plan, (2) the work lessened immediate threats to nearby property from a 5-year flood event and Lee was only a 4.6-year flood event, and (3) prior bank armoring was not engineered. On April 3, 2015, the Applicant presented the information at Headquarters.

Summary Paragraph

Beginning on April 30, 2010, severe storms, tornadoes, heavy rains, high winds, flooding, and flash flooding caused the creek bed of Sycamore Creek to erode and the Applicant’s gas pipes to become exposed. During the final review of Project Worksheet (PW) 5451, FEMA denied funding for the directional boring method used by the Applicant to restore its natural gas pipes because it determined that the process was not the most cost effective method and there was no regulatory requirement for it. Instead, FEMA obligated PW 5451 to excavate the embankment areas, remove the pipes, relocate the pipes, and backfill the embankment areas. In the first appeal letter, the Applicant asserted that there was no conclusive evidence that the pipes were not damaged, the existing pipes could not have been reused, and natural gas regulations require operators to bury pipes in a safe manner that would prevent the pipes from becoming uncovered. The Applicant also asserted that, due to winter weather and time constraints, directional boring was the only method that would prevent future exposure. The Region IV Regional Administrator (RA) denied $559,964.86 in additional funding to complete the project as it was neither necessary nor cost effective, and the Applicant failed to provide a regulatory justification for the additional work performed during the restoration of its gas pipes located below Sycamore Creek. In the second appeal, the Applicant asserts that simply replacing the lost creek bed material to pre-disaster condition was not possible because this method does not comply with federal natural gas line regulations and is prohibited by Tennessee Department of Environment and Conservation requirements. In addition, the Applicant claims the only available option was to utilize directional boring due to winter weather and time constraints. Pursuant to the Stafford Act § 406(e) and 44 C.F.R. Parts 9 and 10, the requested scope of work is eligible for PA funding.

FEMA Announces Notice of Funding Opportunity for Fiscal Year (FY) 2015 Emergency Management Performance Grant

WASHINGTON—Federal Emergency Management Agency Administrator Craig Fugate today announced the release of the FY 2015 Notice of Funding Opportunity for the Emergency Management Performance Grant (EMPG) Program. The FY 2015 EMPG Program provides over $350 million to assist state, local, tribal, and territorial governments in preparing for all hazards, as authorized by the Robert T. Stafford Disaster Relief and Emergency Assistance Act.

Delivering core capabilities requires the combined effort of the whole community, rather than the exclusive effort of any single organization or level of government. The FY 2015 EMPG Program supports efforts to build and sustain core capabilities across the prevention, protection, mitigation, response, and recovery mission areas.

Under the Stafford Act, FEMA is authorized to make grants to bolster emergency preparedness for the protection of life and property in the United States. The Federal government, through the EMPG Program, provides necessary direction, coordination, guidance, and assistance so that a comprehensive emergency preparedness system exists for all hazards and for all levels of government.
