FEMA Supports Legislative Change to Allow Tribal Governments to Directly Apply for Federal Disaster Aid

WASHINGTON, D.C. — FEMA Administrator Craig Fugate released a letter of support for specific legislation in both the United States Senate and House of Representatives that would allow federally recognized tribal governments to make a request for a federal emergency or disaster declaration directly to the President. In December last year, FEMA announced its support to amend the Robert T. Stafford Disaster Relief and Emergency Assistance Act to allow tribes to make a request directly to the President for declarations. Currently, only states and their governors can make such requests.

“Our country’s tribal nations and leaders are an integral part of our national fabric,” said Fugate. “FEMA is committed to supporting Indian Country in its efforts to build resilient communities that are prepared for all hazards.”

Currently, the law states that only the governor of an affected state can request a major disaster or emergency declaration from the President under the Stafford Act. Federally recognized tribes are excluded from making such a direct request for a Presidential declaration and must make a request through the state or states in which they are geographically located.

This process, however, limits FEMA from effectively working with federally recognized tribes on a government-to-government basis. To improve the way we serve and engage the entire community in emergency management, FEMA and the Obama Administration support a legislative change to the Stafford Act that would authorize tribal governments to make requests directly to the President for a federal emergency or disaster declaration. Additionally, FEMA supports a legislative change that would also give tribal governments the option to receive assistance as they do presently, as part of a declaration for a specific state.

Legislative proposals to change the Stafford Act in favor of this amendment have been introduced in both the United States Senate and the United States House of Representatives. If passed, such an amendment would acknowledge the right of federally recognized tribes to ask for direct assistance in a major disaster scenario, enhance FEMA’s working relationship with tribal governments, and improve emergency and disaster responsiveness throughout Indian Country.

FEMA affirms its commitment and is actively working with Indian Country and our Congressional partners to support and facilitate the passage of such a change in the law. FEMA Administrator Fugate has conducted listening sessions and has committed to reviewing all existing Agency policies and programs to ensure tribal concerns are addressed. This support for an amendment to the Stafford Act, allowing for direct tribal government emergency and major disaster declaration requests, is a result of the President’s focus on working more closely with tribes on disaster relief.

DENVER – The U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) has authorized the use of federal funds to help with firefighting costs for the High Park Fire located in Larimer County.

FEMA Regional Administrator Robin Finegan approved the state’s request for a Federal Fire Management Assistance Grant (FMAG) at 7:19 p.m on June 9, 2012. The fire has burned in excess of 4,000 acres of federal and state/private lands.

At the time of the request the fire was threatening 150 homes in and around Fort Collins, population 299,630. The fire is also threatening campgrounds in the area, the Stove Canyon and Poudre Canyon watersheds and an unknown amount of other infrastructure.

The authorization makes FEMA funding available to pay 75 percent of the state’s eligible firefighting costs under an approved grant for managing, mitigating and controlling designated fires.

FMAGs are provided through the President’s Disaster Relief Fund and made available by FEMA to assist in fighting fires that threaten to cause a major disaster. Eligible items can include expenses for field camps; equipment use, repair and replacement; mobilization and demobilization activities; and tools, materials and supplies.

These grants do not provide assistance to individual home or business owners and do not cover other infrastructure damage caused by the fire.

DENTON, Texas — One major hurricane, which resulted in a federal disaster declaration, serves as reminder to New Mexicans that now’s the time to prepare for the upcoming hurricane season.

The 2012 Hurricane Season begins on June 1, and while experts are predicting a slower season than in past years, most of the predictions still call for at least a normal amount of activity. The 50 year average is a little over 11 named storms, six of those becoming hurricanes and two becoming major ones – Category 3 or higher.

Reports show that New Mexico has had one storm that resulted in a federal declaration. It was an emergency declaration for Hurricane Katrina (2005) and resulted in the state receiving a more than $1 million in federal disaster aid under the Federal Emergency Management Agency’s (FEMA) Public Assistance program.

The state received an emergency declaration after Katrina impacted Louisiana. The funding was made available to reimburse New Mexico for its costs related to housing Katrina evacuees.

In addition to hurricane winds and rain, the season also brings threats of flooding and tornadoes which can and have impacted states that are not on the coast.

“The bottom line is that New Mexicans should be prepared for all hazards,” said Acting FEMA Region 6 Administrator Tony Robinson. “We say it often, but it’s the best way to get a clear message out there – Get a Kit, Make a Plan and Stay Informed.

DENTON, Texas — Sixteen hurricanes and six tropical storms since 1956, which resulted in federal disaster declarations, serve as reminders to Louisianans that now is the time to prepare for the upcoming hurricane season.

The 2012 Hurricane Season begins on June 1, and while experts are predicting a slower season than in past years, most of the predictions still call for at least a normal amount of activity. The 50 year average is a little over 11 named storms, six of those becoming hurricanes and two becoming major ones – Category 3 or higher. In the last 55 years, Louisiana has had 22 storms that resulted in federal declarations. Sixteen were hurricanes and six were tropical storms.

The hurricanes were two unnamed storms (1956 & 1957), Hilda (1964), Betsy (1965), Camille (1969), Edith (1971), Carmen (1974), Juan (1985), Andrew (1992), Georges (1998), Lili (2002), Ivan (2004), Katrina (2005) Rita (2005), Gustav (2008), and Ike (2008). The tropical storms were Allison (1989), Frances (1998), Allison (2001), Isidore (2002), Cindy (2005), and Lee (2011).

Six of the hurricanes and four of the tropical storms occurred in the last decade and resulted in Louisiana receiving more than $35.5 billion in federal disaster aid. That assistance fell under both the Federal Emergency Management Agency’s (FEMA) Public Assistance (PA) and Individuals and Households (IHP) programs and included funding for direct housing, crisis counseling, disaster legal services, disaster unemployment, and U.S. Small Business Administration (SBA) low-interest disaster loans.

“These statistics more than demonstrate the need for all Louisianans to be prepared,” said Acting FEMA Region 6 Administrator Tony Robinson. “We say it often, but it’s the best way to get a clear message out there – Get a Kit, Make a Plan and Stay Informed.

The hurricane was Katrina (2005) and the tropical storms were Gustav and Ike (2008). All three occurred in the last decade and resulted in Arkansas receiving a total of $51.9 million in federal disaster aid under the Federal Emergency Management Agency’s (FEMA) Public Assistance program.

The state received an emergency declaration after Katrina impacted Louisiana. The funding was made available to reimburse Arkansas for its costs related to housing Katrina evacuees. Meanwhile, tropical storms Gustav and Ike brought inland flooding to Arkansas and caused major damage to its public infrastructure.

ESSEX JUNCTION, Vt. — The State of Vermont, municipalities, and some non-profit groups will be getting more federal money to reimburse them for costs incurred during Tropical Storm Irene and the subsequent clean up and repairs.

The Federal Emergency Management Agency announced today that President Obama has approved Vermont Governor Peter Shumlin’s request for the federal government to reimburse applicants for 90 percent of the eligible costs to repair or restore infrastructure damaged by Irene instead of the standard 75 percent.

“This announcement marks a major milestone in our recovery from Tropical Storm Irene,” Governor Shumlin said. “It will mean significant savings for municipal budgets across the state, and for the state budget as well. We are incredibly grateful to President Obama and the Congressional Delegation, and also to FEMA for this welcome news.”

“We hope that this will help the state and its communities in their ongoing recovery,” said Federal Coordinating Officer James N. (Nick) Russo, the head of FEMA’s mission in Vermont. “We know that Vermont and its towns and cities are working as hard as they can to repair damage, and we’re working hard to get them their money.”

The FEMA Public Assistance (PA) program provides funding to repair roads and bridges, put water systems and electric utilities back in order, rebuild libraries and replace damaged books, repair hospitals and emergency services, rebuild schools and universities, and pay for other infrastructure restoration statewide.

It also reimburses communities and certain private non-profits for expenses associated with debris removal, emergency protective measures like search and rescue operations, and the cost of eliminating public safety or health hazards, like removing animal carcasses or demolishing unsafe buildings.

FEMA’s PA program typically reimburses 75 percent of the eligible cost of these projects, with the state and municipality sharing the remainder.

However, according to FEMA’s regulations up to 90 percent reimbursement is permitted if actual federal aid to a state for a disaster, minus FEMA’s administrative costs, meets or exceeds $127 per person.

With a population of 625,741 according to the U.S. Census Bureau, that means if the actual cost of FEMA aid to the state exceeds $79,469,107 the state becomes eligible for 90 percent reimbursement, at the discretion of the president.

So far FEMA has obligated, or paid to the state, approximately $64.7 million in reimbursement for Public Assistance projects related to Tropical Storm Irene, as well as $22 million in Individual Assistance to individuals and families for losses.

The increased reimbursement will be provided to both completed projects and those in process. It will not apply to projects related to the spring 2011 flooding.

WASHINGTON, D.C. — Every year, thirty days from the start of hurricane season, FEMA officials urge U.S. residents to prepare their homes and businesses for the heightened flood risks associated with hurricanes and tropical storms. This year, FEMA is placing more urgency in this message due to the expiration of the National Flood Insurance Program (NFIP) on May 31, 2012, the day before the 2012 hurricane season begins on June 1st.

The authorization for the National Flood Insurance Program is scheduled to expire on May 31 unless Congress acts in advance to reauthorize it. The NFIP makes federally backed flood insurance available to homeowners, renters and business owners. The NFIP identifies areas of flood risk; it encourages communities to implement measures to mitigate against the risk of flood loss; and it provides financial assistance to help individuals recover rapidly from flooding disasters.

“Flood insurance is essential to help protect against the devastating effects of flooding, and the time to act is now,” said David Miller, Associate Administrator for FEMA’s Federal Insurance and Mitigation Administration. “As we approach a potentially active hurricane season, FEMA is urging Congress to reauthorize the NFIP and send a clear signal to citizens, communities, and private sector partners that the federal government will continue to support our nation’s efforts to manage flood risk.”

Flooding is the most common and costly natural disaster to affect every state across the country. Severe weather has already brought significant flood events to many states in the U.S. As we continue to monitor conditions and respond to these events, we must also look forward to summer and hurricane-related weather patterns that will heighten flood risks for many.

FEMA also stresses that flood risks associated with hurricane season extend beyond the Gulf and Southeastern coasts. The largest amounts of rainfall from hurricanes are often produced by slow moving storms that stall out miles from a shoreline as did Tropical Storm Lee in 2011. In addition, last year Hurricane Irene caused major flooding over much of the mid-Atlantic and Northeast when it moved inland, with high winds and torrential rains.

FEMA is urging residents to purchase flood insurance now. Flood insurance is available through more than 85 insurance companies in nearly 22,000 participating communities nationwide. Most everyone can purchase flood insurance – including renters, business owners, and homeowners. Flood insurance is also affordable. The average flood insurance policy is around $625 a year. And in moderate- to low- risk areas, homeowners can protect their properties with low-cost Preferred Risk Policies (PRPs) that start at just $129 a year.
